Custom contractual protections below remain non-operative proposals; viewing this page does not activate them or record acceptance.

Release status and authorized use

This is the RichWEB umbrella website for independent apps, web tools and development projects. Product availability and release status are identified in each project section. Use the website and tools lawfully and only submit material you have authority to use. Do not abuse the forms, interfere with service or upload secrets.

Project information and online tools

Availability, compatibility and store terms differ between projects. AppleSoft Compiler is an experimental subset of Applesoft, not complete compatibility or hardware certification. It creates code and data images, not a licensed Apple OS. New data disks cannot boot. App Store purchases and app licensing are governed by the applicable product and Apple terms.

Disclaimer of warranties

To the fullest extent permitted by applicable law, the RichWEB website and tools are provided as is and as available, without express, implied or statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy or uninterrupted operation. Peter Richards, individually, and RichWEB, LLC do not warrant that the website or tools will meet every requirement or operate without defects. Warranties and remedies that cannot lawfully be disclaimed remain in effect.

Proposed release and hold harmless

To the fullest extent permitted by applicable law, the proposed release would release and hold harmless Peter Richards, individually, and RichWEB, LLC (the Protected Parties) from claims, losses and damages arising from use of the RichWEB website and tools, including claims based on a Protected Party’s ordinary negligence. This proposal is subject to the Rights and exceptions section and does not waive claims or remedies the law does not allow to be waived. Peter Richards is an intended beneficiary in his individual capacity. Appropriate legal review and an implemented acceptance process are required before relying on these proposed contractual protections.

Unrelated failures and limitation of liability

The Protected Parties are not responsible for unrelated hardware failures or third-party outages they did not cause or contribute to. A failure occurring during use does not by itself establish causation. This does not excuse responsibility for harm actually caused where the law provides a remedy.

To the fullest extent permitted by applicable law, neither Peter Richards, individually, nor RichWEB, LLC is liable for indirect, incidental, special, consequential or punitive damages arising from use of or inability to use this website or its tools, including lost profits, lost data or business interruption, even if advised of the possibility. This limitation applies only where lawful and is subject to the Rights and exceptions section.

Proposed indemnification for misuse

To the fullest extent permitted by applicable law, the proposed terms would require indemnification of the Protected Parties against third-party claims and reasonable, documented legal costs to the extent caused by unauthorized or unlawful use or infringement of another person’s rights. It would not cover the portion caused by a Protected Party’s negligence or misconduct, or a legitimate claim brought for a defect or injury. This remains a proposal for appropriate review.

Rights and exceptions

Nothing excludes or limits liability for fraud, willful misconduct or gross negligence by a Protected Party. Death, personal injury, product liability, consumer protection, privacy rights and other statutory rights or remedies are not excluded or limited where applicable law prohibits doing so. If a protection is unenforceable, it applies only to the extent permitted; no clause guarantees immunity from a lawsuit. No acceptance record is created by browsing, scrolling or opening this website.

Ownership and product licenses

RichWEB’s original branding and site content belong to their applicable owners. Third-party fonts, tools and software retain their licenses. The AppleSoft compiler’s GPLv3-or-later and GCC Runtime Library Exception 3.1 remain separate and are not restricted by these proposed terms. Independently supplied BASIC stays its owner’s work. Apple, App Store, OpenAI, Codex and other descriptive product names remain with their respective owners; no sponsorship or affiliation is implied.

Contact

Questions and requests can be sent through the studio contact form once configured. Product support has its own project form. RichWEB, LLC is the website operator; applicable mandatory consumer rights remain in effect.
